In context to private family matters there are International human rights and standards along with children's Right's that safeguards the children life by implementation of various laws and Acts in Irish Constitution. These laws and acts consider all the matters of children's right's like the better living, educational rights, requirement of parents, financial right's and various other in domestic family practice like guardianship, custody and adoption.

The Article 42 Act is recently been activated to ensure safety of children's right's that is getting affected due to failed legal processes. Though the 2015 Act, signed on 16 April, 2015 is still not activated, it can be hoped that it will surely provide reform in this legal ares for betterment of children.

The UNCRC (UN Convention on the Rights of the Child) provides International Human Rights that safeguard children's rights in terms of guardianship, custody and access over children. The Article 7, 8 and 18 of human rights ensures that children will have relationship with their parents irrespective of their marital status. The Article 5 ensures roles; responsibilities and duties that parents involved in guardianship, adoption or custody have to follow for children's rights in family matters.

The Guardianship Rights define the role and responsibility of guardian parent who can be parents after marriage or mother having child outside marriage. The Guardian Rights are applicable to right of custody as well. This law safeguards all the children's essential rights like education, welfare and health requirements.

The 2015 Act once in force will provide various modifications in on going Irish law related to children's rights. Some of the most important changes that will occur are described below: -

  • This act includes children's rights for residence, religion, spiritual, cultural, medical requirements and linguistic matters for the first time in Irish law

  • Any relative or any person related to care of child can apply for custody as per children's rights in Act of 2015

  • The 2015 Act also considers that, child's physical, emotional and psychological needs are really important parts in children's rights process.

  • There will be a process initiated by 2015 Act that will involve practice of hearing children's voice and views in family matter for benefit of children and profit their children's rights. But, this process will be dependant on certain factors like age, gender and other.

These are some of the most important & significant changes that will get activated after the incoming of Children & Family Relationships Act 2015 in Irish Constitution for betterment of children's rights.
